Gaining Exemption from "Fit to Work" Decisions in ESA
Today, Black Triangle is launching our campaign to encourage the mass take-up of Regulations 29 and 35.
Working closely with all our members, supporters and our sister organisation Disabled People Against Cuts, we must rapidly ensure that EVERY sick and/or disabled person in Britain facing the inhuman DWP/Atos WCA abomination and their GPs (and Consultants, where applicable) are fully up-to-speed on the use and application of these regulations which grant lawful exemption and immunity from adverse Atos WCA decisions.
We believe that, properly applied (we explain how is some detail), their use may save tens, perhaps hundreds of thousands of sick and/or disabled people from untold suffering.
Everybody can play their part in this campaign by spreading the word as far and wide as possible. Please print out the draft letters and explanatory notes and submit them to your local medical centres/surgeries as well as any local advice and advocacy agencies. You may even save lives.
Commenting on the recent case of Brian McArdle, 57, who died tragically just days after his Atos WCA the DWP issued the following statement:
From now on ~ Let there be no more excuses! Let the DWP never be able to say again “we never knew – the necessary evidence was never provided”!
Please – in all cases – provide us with the feedback we need as to whether or not this has been appropriately applied by DWP Decision Makers to give the decision it was designed for.
We are ready to pursue a case against them if they do not!

DLA reform and Personal Independence Payment – completing the detailed design
UPDATE: Please take a minute to complete our short survey about PIP and how it will be implemented. The current consultation will end at midnight on 29th June so your responses before then would be appreciated so that an informed submission can be made by us to the DWP.
Amongst other things this latest consultation asks for responses to questions about stopping DLA (and PIP) for those in Hospital for more than 28 days, which would mean a significant number of people with Motability cars would lose them for comparatively simple ailments that nonetheless affect disabled people disproportionately because of their underlying health conditions, eg Asthma, Diabetes, MS.
There are also questions about the timetable for introduction of PIP from April next year. They plan to give only 4 weeks notice to those currently on DLA (any rate) to apply for PIP otherwise their DLA stops.
Another section deals with requiring those currently on means tested benefits to undergo a WCA (Work Capability Assessment) AS WELL AS A PIP ASSESSMENT from 2017 when the change over to Universal Credit is completed.

This consultation seeks views on the Government’s proposals on some of the benefit rules underpinning Personal Independence Payment, Disability Living Allowance, Carer’s Allowance and Attendance Allowance.
